You are responsible for activity conducted through your account except to the extent caused by our failure to use reasonable security measures.

You may not impersonate another person, create an account using information you are not authorized to use, or transfer your account without our written permission.

Prices, taxes, payment schedules, and material purchase terms will be displayed before you complete a transaction.

You authorize us or the applicable payment provider to charge the payment method you select. Purchases made through an application marketplace may also be governed by that marketplace’s payment terms.

Except where applicable law or a specific offer provides otherwise, purchases are final and non-refundable.  Non-customized products can be returned for an instore credit or refund,  if in the unopened original packaging and at the discretion of the store manager.

Nothing in these Terms limits refund, cancellation, or other rights that cannot legally be waived.

6. Company Content and Intellectual Property

The Services—including their software, design, text, graphics, branding, and other content supplied by us—are owned by or licensed to the Company and are protected by intellectual-property laws.

Except for the limited permission granted in these Terms, no right or license to our intellectual property is granted to you. You may not use our names, logos, or trademarks without prior written permission.

If you provide suggestions or feedback, we may use them without restriction or compensation, provided that doing so does not give us ownership of your personal information or confidential materials.

7. Third-Party Services

The Services may link to or interoperate with third-party websites, applications, payment processors, app stores, devices, or services. Those third parties operate under their own terms and privacy practices.

We are not responsible for third-party services except to the extent applicable law provides otherwise. A link or integration does not necessarily constitute our endorsement.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis to the extent permitted by law.

We do not promise that the Services will always be uninterrupted, error-free, completely secure, or suitable for every purpose. Any specific warranties expressly provided with a product or service remain subject to their stated terms.

Some jurisdictions do not permit the exclusion of certain warranties. In those jurisdictions, the exclusions in this section apply only to the extent legally permitted.

9. Limitation of Liability

To the maximum extent permitted by law, neither the Company nor its directors, employees, affiliates, or service providers will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or relating to the Services.

Our aggregate liability arising from or relating to the Services will not exceed the lesser of (a) the amount you paid us during the twelve months preceding the event giving rise to the claim or (b) $1,000,000.

These limitations do not apply to liability that cannot legally be excluded or limited, which may include liability for fraud, willful misconduct, gross negligence, personal injury, or violations of mandatory consumer rights.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold the Company harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, or User Content that infringes another person’s rights.

This obligation does not apply to claims caused by the Company’s own unlawful conduct, negligence, or breach of these Terms.

11. Suspension and Termination

You may stop using the Services at any time. You may request account deletion through info@vibranthomellc.com

We may suspend or terminate access if we reasonably determine that you materially violated these Terms, created a security risk, used the Services unlawfully, or failed to pay amounts due.

Where reasonable and legally required, we will provide notice and an opportunity to remedy the issue. Sections that logically should survive termination—including ownership, accrued payment obligations, liability provisions, and dispute provisions—will remain effective.

12. Changes to These Terms

We may update these Terms to reflect changes to the Services, law, security needs, or business practices.

We will post the revised Terms and update the “Last updated” date. If a change materially affects your rights, we will provide additional notice and obtain renewed agreement where required by law. Changes will not apply retroactively unless the law permits and the revised Terms clearly state otherwise.

13. Governing Law and Disputes

These Terms are governed by the laws of Maryland, USA, without regard to conflict-of-law principles.

Any dispute will be heard in the courts located in Anne Arundel County, Maryland, USA, and each party consents to their jurisdiction, except where mandatory consumer law permits or requires a different court or governing law.

Nothing in these Terms deprives a consumer of mandatory protections provided by the laws of their place of residence.

14. General Provisions

These Terms and the documents expressly incorporated into them constitute the agreement between you and the Company concerning the Services.

If a provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of relevant assets, subject to applicable law.

Headings are included only for convenience.
